L'Italia post #elezioni2013 e il #razzismo istituzionale



Uno studente quasi nascosto in fondo all'aula della conferenza dopo un po' di titubanza fa una bella domanda: ma la legge (italiana) è fatta per aiutare o per mettere in difficoltà?

Siamo alle ultime battute della mattinata, presso il Centro di Formazione Professionale – CFP – “Città dei Ragazzi”, dove ha avuto luogo la presentazione del Corriere Immigrazione (dunque colgo anche l'occasione per segnalarvelo).
Qualche giornalista, e una platea per lo più di giovani studenti del CFP, in maggioranza di origine straniera. Quale luogo migliore dunque?

Sono partito da quella domanda, perché per banale che possa sembrare, a guardare bene le leggi nel nostro paese, un quesito come questo non è affatto scontato, anzi è fondamentale. Ancor più se a porlo è uno studente di origine straniera che vive e studia in Italia.

A volte alcune cose si danno per ovvie, non per cattiveria, ma succede. Nelle ore immediatamente successive alle elezioni, mentre con gli altri ragazzi di intervistato.com seguivamo in diretta l'evolversi della situazione, avevo chiesto a Maria Petrescu (il nostro volto ufficiale, in video e non) per chi avesse votato. Una domanda nella mia testa normalissima, ma che come risposta aveva ricevuto, anche se bonariamente, un qualcosa di simile a: Matté ma sei scemo?

Già, perché Maria, che parla e scrive italiano (oltre a una indefinita quantità di lingue) meglio di me e di molti professori titolati, pur essendo in Italia da anni e anni, non ha potuto votare. Non ha la cittadinanza. Eppure, per me che la conosco da quasi otto anni oramai, Maria è Italianissima. Cose che succedono ma che inevitabilmente finiscono per metterti davanti a certi meccanismi  burocraticamente macchiavellici e ingiusti.

Tornando alla mattinata passata al CFP, un altro ragazzo pone la seguente domanda: "perché io, che sono Pakistano e in Italia da 10 anni non ho ancora la cittadinanza mentre un mio amico, che però ha madre Italiana, la cittadinanza l'ha avuta dopo soli 8 anni? Non è giusto!"

Già, perché? A rispondere, come nel primo caso, è Stefania Ragusa, direttore responsabile di Corriere Immigrazione: "è normale, perché la cittadinanza dell'altro ragazzo si poggia sullo ius sanguinis. Normale perché nella norma ma non per questo giusto."

Il sito del Ministero dell'Interno riporta:

La legge 91 del 1992 indica il principio dello ius sanguinis come unico mezzo di acquisto della cittadinanza a seguito della nascita, mentre l'acquisto automatico della cittadinanza iure soli continua a rimanere limitato ai figli di ignoti, di apolidi, o ai figli che non seguono la cittadinanza dei genitori.

In Italia il dibattito sul tema è sempre sotto la brace, ogni tanto si riaccende. Un anno fa la campagna "l'Italia sono anch'io" che raccolse 100.000 firme per una legge di iniziativa popolare. Poi la cosa si arenò, Riccardi disse che spettava al parlamento esprimersi, e siamo arrivati ad oggi dove il tema è riemerso durante l'ultima campagna elettorale. Il PD lo ha inserito negli 8 punti e ha portato in parlamento un disegno di legge sull'acquisizione di cittadinanza a firma Bersani, Speranza, Chaouki e Kyenge (presente anche all'evento di cui state leggendo). 

Razzismo istituzionale, questo il termine uscito durante la presentazione. Un termine forte, è vero, ma non sbagliato. Ne sono la prova le tre storie raccontate nel documentario "La legge (non) è uguale per tutti" proiettato in questa occasione. Da Kindi,  a cui dopo essere arrivata quasi alla fine del percorso di studi viene negato l'accesso alla specializzazione, passando per la storia di Said e Vanessa, accaduta proprio a Modena, dove lui viene portato al CIE di Bologna pochi minuti prima di pronunciare il fatidico SI davanti alla sua futura sposa, arrivando alla vicenda di due fratelli, Andrea e Senad nati e cresciuti in Italia ma (vai a capire le cose della burocrazia) ritenuti apolidi e quindi rinchiusi nel CIE di Modena. Ve lo proponiamo qui sotto:


 
La speranza è che il nuovo parlamento appena eletto, che vede anche figure come quella di Laura Boldrini nella veste di presidente della Camera dei deputati, trovi nuovo slancio per legiferare velocemente in materia mettendo fine a quello che, come ho imparato oggi, possiamo benissimo chiamare Razzismo Istituzionale, o Razzismo di Stato.

Institutional racism

A student almost half hidden in the last row of the conference room, after a bit of hesitancy asks a good question: is the Italian law made to help people or make things more difficult?

We're at the last minutes of the morning session at the Center of Professional Formation - CFP - "City of young people", where the presentation of Corriere Immigrazione just took place.

A few journalists, and an audience made up for the most part of young students of the CFP, the majority of which were foreigners. So what better place than this one?

I've started from that question, because as simple and obvious as it might seem, if you look at the laws in our country, such a question is all but obvious, it's actually crucial. Even moreso if the one asking it is a foreign student who lives and studies in Italy.

Sometimes some things are given for granted, not out of wickedness, it just might happen. During the hours immediately after the elections, as we followed the live evolution with the other members of Intervistato.com, I asked Maria Petrescu (our official face, in video and not only) who she voted for. A question that in my head was perfectly normal, but which had as an answer - even if spoken with affection - a: Matteo, are you effin serious?

Indeed, because Maria, who speaks and writes in Italian (along with a number of other languages) better than me and many professors, even though she has been in Italy for many years, couldn't vote. She doesn't have the citizenship. And yet, for me who have known her for eight years now, Maria is extremely Italian. Things that happen but which inevitably end up by putting right in front of you certain mechanisms that are bureaucraticaly Machiavelli like and unjust.

Coming back to the morning at the CFP, another young man asks the following question: "why is it that I, who am a Pakistani and have been in Italy for 10 years, still don't have the citizenship, while a friend of mine, who has an Italian mother, had the citizenship just after 8 years? It's not fair!".

Yes, why? Giving the answer, as in the first case, is Stefania Ragusa, responsible director of Corriere Immigrazione: "it is normal, because the citizenship of the other boy is based on the ius sanguinis. Normal because in the norm, but not for this reason just and fair."

The website of the Ministry of Internal Affairs says:

"The law 91 of 1992 indicates the principle of the ius sanguinis as the only mean of acquisition of citizenship following birth, while the automatic acquisition of the citizenship iure soli continues to be limited to the sons of unknown, stateless or to the sons who don't follow the citizenship of the parents."

In Italy the debate on this topic is always alive under the ashes, and every now and then the flames rise. One year ago the campaign "Italy is me as well" managed to collect 100.000 signatures for a popular initiative law. Then it all slowed down and stopped, Riccardi said that it was the Parliament's duty to decide, and here we are today, when the topic emerged again during the last elections campaign. PD has put it among the 8 points and brought to the Parliament a law proposal on the acquisition of citizenship, signed Bersani, Speranza, Chaouky and Kyenge (who was also present at the event you're reading about right now).

Institutional racism, this was the term emerged during the presentation. A strong term, true, but not wrong. The proof are the three stories told in the documentary "The law is (not) the same for everyone)", which was presented in this occasion. From Kindi, who after arriving almost at the end of the studies path sees her access to specialization denied, to Said and Vanessa, when he is brought to the CIE of Bologna just minutes before saying "Yes" to his wife to be, arriving at the story of two brothers, Andrea and Senad, born and grown in Italy but (go figure the sense of bureaucracy), considered stateless and thus put in the CIE of Modena. The hope is that the brand new elected Parliament, which also has figures such as Laura Boldrini as the president of the Chamber, finds new energy to quickly make laws on this matter, ending what - as we learned today - can be easily defined Institutional Racism, or State Racism.

10minuticon Riccardo Noury @riccardonoury



Qualche giorno fa Riccardo Noury, portavoce di Amnesty International Italia, ci ha concesso un'intervista a proposito dei diritti umani e civili in Italia.


In primo luogo abbiamo chiesto a Riccardo come è nata l'idea dei 10 punti proposti ai candidati alle elezioni politiche del 2013: si è trattato di un'esigenza di chiarezza, trasparenza, e assunzione di responsabilità che Amnesty sentiva di dover chiedere a chi si candidava alla guida del Paese. La situazione dei diritti in Italia preoccupa, ci sono molti problemi irrisolti che si sono acuiti nel tempo, lacune e ritardi legislativi che devono essere colmati. Per questo motivo si è pensato di dover fare queste 10 richieste, un'agenda di riforme sui diritti umani.

Il pacchetto di riforme è stato sottoposto a sette candidati e a tutti i parlamentari sul territorio, e le risposte sono state piuttosto interessanti: i calcoli non sono ancora completi, ma circa 80 - 90 parlamentari hanno sottoscritto le richieste di Amnesty, e tutti i leader tranne uno hanno risposto in maniera più o meno completa. Berlusconi, Bersani e Monti hanno risposto sì ad almeno 9 richieste su 10, mentre l'unico che ancora non ha dato alcun riscontro è Beppe Grillo.

Per quanto concerne la condizione della donna in Italia, abbiamo chiesto quali sono le misure che bisognerebbe attuare per garantire il rispetto dei diritti delle donne e per fermare i femminicidi. Riccardo ha specificato che Amnesty chiede il rispetto delle norme internazionali, quindi il primo passo sarebbe la ratifica immediata del Trattato di Istanbul, che prevede una serie di provvedimenti contro la violenza domestica. E' necessario investire nei centri antiviolenza, rafforzarne le strutture e l'importanza, e prendere una serie di misure sul piano legislativo, e prevedere sanzioni più dure. In più c'è un aspetto culturale, perché bisogna cessare di usare espressioni e stereotipi discriminatori nei confronti della donna.

Sugli abusi delle forze di polizia, Riccardo ha citato la lunga storia di maltrattamenti e torture iniziata già nel 2001: l'impossibilità di identificare chi colpiva persone inermi, e comminare sanzioni e pene adeguate alla gravità del reato commesso, ha avuto come conseguenza una scarsità di condanne, e si è data l'idea che in Italia non sia successo qualche cosa di molto grave. E' necessario introdurre l'obbligo del codice alfanumerico per le forze di polizia e introdurre il reato di tortura, un provvedimento sul quale l'Italia è in ritardo di 25 anni.

Abbiamo parlato anche dei diritti degli immigrati, e delle misure da prendere per evitare manifestazioni razziste e xenofobe. Secondo Riccardo è necessario fermare l'incrocio tra criminalizzazione e criminalità, due fatti coincidenti che rendono la vita ai migranti molto difficile. Quandi hai forme di criminalizzazione per legge, e una determinata identità diventa un reato (come nel caso del reato di clandestinità), si pongono le persone nelle mani della criminalità, vittime di sfruttamento da parte di datori di lavoro che non possono denunciare.

Per quanto riguarda i diritti della comunità LGBTQ, bisogna far notare che l'Italia è uno dei pochi paesi europei che non ha legiferato contro l'omofobia o per garantire uguali diritti alle coppie omosessuali come per le coppie eterosessuali: Riccardo specifica che la legislazione è molto semplice, ed è quella che tutela le persone nel nostro Paese da ogni forma di discriminazione a prescindere dall'identità e dall'orientamento sessuale. Ogni impedimento che procura discriminazione va superato con adeguate misure legislative, una grave lacuna che l'Italia ancora deve colmare.

La crisi acuisce le disuguaglianze, e si potrebbe pensare che i diritti passino in secondo piano rispetto a problemi apparentemente più vicini, come il lavoro o i bilanci da tenere sotto controllo, ma non bisogna mai dimenticare che a maggior ragione bisogna dare attenzione a questi temi, perché sono ancora più a rischio in periodi di grave crisi.

Abbiamo parlato anche dei diritti dei carcerati, di coloro che definiscono il 41bis una forma di tortura, e della situazione della comunità Rom in Italia. Naturalmente vi invito a visionare l'intervista integrale, ben più ricca di questa brevissima sintesi.

First of all we asked Riccardo how the idea of the 10 points proposed to the candidates to the political elections in 2013: it was the need of clarity, transparency, and taking responsibility that Amnesty felt it had to ask to those who candidated to guide the country. The situation of rights in Italy is very worrying, there are many unsolved problems that have become more serious in time, lacks in the legislative system that must be solved. That is why they had to write down these 10 requests, an agenda of reforms of human rights.

The package of reforms was sent to seven candidates and to all the members of Parliament on the territory, and the answers have been quite interesting: the calculations aren't yet complete, but about 80 - 90 members have signed the requests, and all the leaders except for one have answered in a more or less complete manner. Berlusconi, Bersani and Monti have answered yes to at least 9 out of 10 requests, while the only one who still hasn't given any kind of answer is Beppe Grillo.

As for the condition of the woman in Italy, we asked what measures should be implemented in order to guarantee the respect of women's rights and to stop the homicides. Riccardo has specified that Amnesty asks for the respect of international norms, so the first step to do is to sign the Treaty of Istanbul, which has a series of measures against domestic violence. It is necessary to invest in anti-violence centres, reinforce the structures and their importance, and take a series of decisions at a legislative level, which would include harsher penalties. There's also a cultural aspect that we cannot forget, because we need to stop using expressions and stereotypes that are discriminatory of women.

About the abuses of the police forces, Riccardo has quoted the long series of abuse and torture which started in 2001: the impossibility to identify those who hit helpless people, and give them sanctions that are adequate to the seriousness of the crime they committed, has had as a consequence a lack of verdicts, and Italy gave the idea that nothing very bad happened. It is necessary to introduce the obligation to wear an alphanumeric code for police forces and introduce the crime of torture, something Italy has been delaying for the last 25 years.

We also talked about the rights of immigrants, and the measures to take in order to avoid racist and xenophobic manifestations. According to Riccardo it is necessary to stop the crossing between criminalization and criminality, two coincidental facts which make life difficult to migrants. When you have forms of criminalization by law, and a certain identity becomes a fellony (like in the case of the crime of clandestinity), you put people in the hands of criminality, victims exploited by employers whom they cannot press charges against.

As for the rights of the LGBTQ community, Italy is one of last few European countries which has no laws against homophobic fellonies or in order to guarantee equal rights to gay couples as for heterosexual couples: Riccardo specifies that the legislation is very simple, and it is the one that protects people in our country from every form of discrimination, regardless of sexual identity or taste. Any impediment that creates discrimination must be overcome with adequate laws, and this is a great problem that Italy still has to solve.

The crisis makes social differences bigger, and one might think that rights would be less important than problems that are apparently more serious, such as unemployment or taxes, but we should never forget that moreso we should pay attention to these rights, because during times of crisis they're extremely at risk.

#DirittiUmani: la fiaba quotidiana



E la principessa e il principe si sposarono e vissero felici e contenti per il resto dei loro giorni. Questo è il finale di quasi tutte le favole che sentiamo da piccoli. Ma nella realtà c'è sempre una grande differenza dopo le classiche parole:… E vissero felici e contenti.

Quando si arriva al gran finale delle fiabe, in genere ci sono il Principe e la Principessa felici, ma quante volte nella realtà le cose sono sempre cosi? Nelle favole che leggiamo ai nostri figli c'è sempre un principe che protegge e salva la sua principessa. Tutt'ora nelle favole i principi sono cosi, buoni, altruisti, hanno la forza e la usano per proteggerci.

Tutt'oggi non solo nelle favole i maschi sono cosi. Ma ancora oggi ed anche nelle società più evolute i principi diventano bestie che picchiano e maltrattano fisicamente le loro compagne, le insultano e le trasformano da principesse in schiave. Si tratta di violenza contro le donne da parte dei maschi.

A ottobre dell'anno scorso, L'Italia ha firmato la Convenzione del Consiglio d’Europa sulla prevenzione e la lotta contro la violenza nei confronti delle donne e la violenza domestica. Questonuovo trattato è il primo strumento internazionale giuridicamente vincolante che crea un quadro giuridico completo per proteggere le donne contro qualsiasi forma di violenza.

L' art. 3 della Convenzione definisce "La violenza contro le donne" come “una violazione dei diritti umani e una forma di discriminazione contro le donne” e si intendono tutti gli atti di violenza di genere che si traducono in, o sono suscettibili di provocare, danno fisico, sessuale, psicologico o economico o sofferenza alle donne, incluse le minacce di tali atti, la coercizione o la privazione arbitraria della libertà, sia in pubblico che nella vita privata.

Purtroppo, la violenza sulle donne resta un problema attuale anche in Italia, e secondo i dati dell'ISTAT è in continua crescita il numero delle vittime di femminicidio. Nel 2012 in Italia 117 donne sono state uccise da un familiare o conoscente. I dati rivelano anche che la violenza domestica risulta la più diffusa, in quasi 70% dei casi. Quindi la violenza sulle donne è un grande problema in primo luogo della convivenza domestica, nonché di relazioni umani fra uomo e donna. Secondo lo stesso ISTAT, il 93% dei casi non vengono segnalati, rimanendo sconosciuti, invisibili, inesistenti.

Finalmente con l'adesione alla Convenzione sopra citata, dovrebbe essere possibile delineare un quadro completo di politiche e misure per la protezione e l'assistenza a tutte le vittime della violenza contro le donne e la violenza domestica. Ogni paese che aderisce e quindi anche l'Italia, dovrebbe garantire l'effettiva attuazione delle sue disposizioni e quindi adottare la legge di ratifica della convenzione.

A quanto spiega Marina Calloni, ordinario di filosofia politica nell'Università di Milano-Bicocca, in Italia ancora non c'è una legge organica che disciplini in maniera completa questo grave problema, un metodo uniforme che possa coinvolgere con un approccio integrato e strategico tutti i soggetti implicati, non ci sono azioni standardizzate per prevenire e monitorare il fenomeno della violenza contro le donne.

Volevo capire meglio come sono organizzate sul territorio le associazioni che aiutano le donne in difficoltà e ho fatto alcune domande ad una mia amica che è stata responsabile di una casa di accoglienza per le donne maltrattate. La prima cosa che mi ha detto è che non esiste una normativa a livello nazionale che regoli questo aspetto, ma ogni provincia fa come crede. Lei definisce il sistema come un sistema a “macchia di leopardo”.

C'è tanto volontariato, associazionismo, cooperative, ognuno nel suo piccolo porta avanti un progetto indirizzato ad aiutare le donne che subiscono violenze. C'è il telefono rosa che offre accoglienza telefonica 24h su 24 anche ai minori che subiscono violenza in famiglia. Ci sono le forze di polizia dove le donne vanno a sporgere le denuncia che poi indirizzano le donne a rivolgersi ai Servizi Sociali. Ci sono i giudici, i mediatori culturali, ci sono leggi che tutelano le donne, come quello contro lo stalking. Ci sono centri specializzati anche nell'inserire la donna in un ambito sociale e renderla indipendente, associazioni che offrono assistenza legale, sociale, psicologica ed economica alle vittime della violenza.

Ma quello che manca è una regolamentazione unitaria. C'è una regolamentazione per i malati mentali, per i minori che delinquono, per gli anziani, per tante categorie sociali ma non per le donne aggredite. La mia amica mi spiega che c'è tanta diversità di servizi offerte alle donne ma non c'è una rete di collegamento trasparente, l'informazione rimane bloccata in piccole macchie di leopardo, la comunicazione viene troncata e alla donna risulta difficile capire come funziona veramente il sistema e quali sono le prospettive che la aspettano nel momento nel quale decide di abbandonare una situazione di violenza, isolamento sociale e sottomissione. Le donne a volte non sanno neanche a chi rivolgersi e non hanno neanche una struttura familiare solida che le possa aiutare.

La violenza domestica è un fenomeno complesso, ed anche se ogni donna ha la sua storia la tipologia è simile: per molto tempo la maggior parte delle donne non denunciano subito il loro partner, ma si rivolgono ai centri sociali solo quando veramente sentono di rischiare la vita.

La storia di Clara non è una fiaba ma una delle tante storie contemporanee. Clara è una delle tante donne in fuga dal marito. Per tutta la vita ha fatto la casalinga, ha dato vita e ha cresciuto tre figli e dopo una vita di violenze subite dal marito, è dovuta scappare e rifugiarsi in una casa per le donne maltrattate. Clara ha vissuto una vita benestante, ma il prezzo da pagare è stato l'isolamento sociale, senza amici e famiglia, la possessività, la sottomissione fino ad arrivare decine di volte in grave condizioni in ospedale. Solo quando ha sentito veramente di rischiare la vita ha avuto il coraggio di scappare e lasciare alle spalle il suo calvario, grazie anche all'aiuto di psicologi e assistenti sociali del Centro Antiviolenza.

Il ruolo dei Centri Antiviolenza per le donne è importantissimo. Oltre ad offrire la prima accoglienza, i centri offrono servizi legali, psicologi, educatori e gruppi di sostegno e di servizi speciali per i bambini delle donne in fuga, orientamento ed accompagnamento al lavoro. Perché è altrettanto importante capire i bisogni di ogni donna e accompagnarla nel miglior modo ad uscire dal ciclo della violenza. Le case rifugio, invece, spesso ad indirizzo segreto, ospitano oltre alle donne anche i loro figli minorenni per un periodo di emergenza.

Ma come funzionano questi centri? Da dove provengono i fondi destinati alle donne maltrattate? Molti Centri Antiviolenza si sono organizzati costituendo una rete territoriale di sostegno alle donne che subiscono violenza e coinvolgendo le forze dell’ordine, i pronto soccorsi, i servizi sociali ed altri enti sensibili al tema. Alcuni sono autofinanziati, alcuni sono stati creati con finanziamenti pubblici, con partnership collaborative pubblico-private e fonti di finanziamento esterne.

Ma i centri non sono considerati un servizio pubblico, come un ospedale, per esempio. Così, alcuni, dopo la fase iniziale di finanziamento ricevuto, con il tempo rischiano la chiusura per mancanza di risorse sufficienti, anche a causa dei tagli alle politiche sociali. Tante di questi centri sono stati costretti a chiudere, come è il caso della casa rifugio coordinata dalla mia amica.

Come risulta dal libro scritto dal giornalista Riccardo Iacona “Se questi sono gli uomini”, in Italia si contano circa 150 associazioni che si occupano di violenza contro le donne, ma ancora poche rispetto alle decine di nuovi casi e ancora pochi sono i fondi stanziati dal governo per l'attuazione delle politiche sociali.

Per concludere, ormai è riconosciuto che un contesto di disuguaglianza sociale e discriminazione tra i sessi è un terreno fertile per la violenza domestica. Quindi da una parte è una questione di cultura, abbiamo il problema del modello maschile e femminile che si trova in un processo di trasformazione e quindi l'educazione dovrebbe essere centrata sui nuovi rapporti e modelli di relazione fra uomo e donna che insieme dovrebbero scoprire e costruire un nuovo senso dei rapporti, della reciprocità, della dignità dello stare insieme.

Sarà sicuramente un processo lungo, ma uomini e donne devono lottare insieme e collaborare per fare qualcosa di concreto a livello culturale e sociale e non cadere nella trappola dalla violenza, del rovescio della medaglia dove gruppi di femministe più radicali, come testimonia una delle prime fondatrici di rifugi per donne vittime di violenza Erin Pizzey, “sotto la copertura dei centri anti-violenza che danno loro fondi e strutture per portare avanti la guerra di genere contro gli uomini, le femministe hanno iniziato a diffondere dati tendenziosi. [...] Vidi le femministe costruire le loro fortezze di odio contro gli uomini, dove insegnavano alle donne che tutti gli uomini erano stupratori e bastardi. Testimoniai il danno fatto ai bambini in tali rifugi. Osservai i “gruppi di consapevolezza” progettati per plagiare le donne e farle credere che i loro mariti fossero nemici da sradicare. [...] Milioni di uomini e bambini hanno sofferto nelle mani di questo malvagio movimento femminista”.

Dall'altra parte ci sono le leggi e le istituzioni che devono aiutare e proteggere le donne maltrattate. C'è bisogno di un piano nazionale contro la violenza, e di fondi per assicurare i servizi alle donne abusate. Il quadro politico e giuridico frammentario e la limitatezza delle risorse finanziarie per contrastare la violenza sulle donne, infatti, è uno dei punti deboli.

Negli ultimi anni ci sono state tante campagne di sensibilizzazione delle istituzioni sul territorio, eventi, raccolte fondi e sensibilizzazioni nelle scuole, pubblicazione di materiale di sensibilizzazione e formazione. Il 14 febbraio 2013 in occasione del evento One Bilion Rising un miliardo di donne e uomini di 189 paesi del mondo balleranno insieme in nome della consapevolezza e della solidarietà, protestando contro la violenza. “Un miliardo di donne violate è un’atrocità” sostiene Eve Ensler, l'ideatrice di questo evento, “un miliardo di donne che danzano è una rivoluzione”.

In attesa della giornata internazionale della donna del prossimo 8 marzo, i politici che regalo ci faranno?

“La violenza contro le donne è forse la violazione dei diritti umani più vergognosa. E forse è la più pervasiva. Non conosce limiti geografici, limiti culturali o di ricchezza. Fintanto che continua non possiamo dichiarare di fare reali progressi verso l'uguaglianza, lo sviluppo e la pace.”-

The daily fable

And the prince and princess got married and lived happily ever after together for the rest of their days. This is the ending of almost all the fables we hear when we're young. But in reality there's always a great difference after the classical words... "and they lived happily ever after".

When we arrive at the great ending of the fables, generally the Prince and the Princess are happy, but how often in reality the things are always that way? In the stories we read our kids there's always a prince who protects and saves his princess. Still in fables the princes are like that, good, caring, strong and willing to protect us.

And yet today not only in fables men are like that. But today, even in the most advanced societies, princes become beasts who strike and mistreat their omen physically, they insult them and turn them from princesses to slaves. It's about the violence of men against women.

In October last year, Italy has signed the Convention of the European Council on prevention and fight against violence towards women and domestic violence. This new treaty is the first international tool which is legally constraining, which creates a complete juridical scenario to protect women against all kinds of violence.

The 3rd article of the Convention defines "violence against women" as a "violation of human rights and a form of woman discrimination" and include all types of gender violence which translate into, or can cause, physical, sexual, psychological, economical damages or suffering in woman, including the threats of these acts, the constraints or the arbitrary deprivation of freedom, both in public and in private life.

Unfortunately, violence against women remains a problem even in Italy, and according to the ISTAT data, the number of victims of feminicide is in constant growth. In 2012 117 women have been killed by a family member or friend in Italy. The data reveal that domestic violence is the most common, in almost 70% of cases. So violence against women is a great problem first of all for domestic living, and also the relationships between man and woman. According the same ISTAT, 93% of cases aren't even reported, and remain unknown, invisible, non existent. 

What does it mean to have an opinion? It doesn't mean anything if that opinion doesn't belong to us. I'm starting this post by giving your the conclusion of my thoughts. But that's just my opinion.

We read newspapers, we watch TV and listen to many politicians, journalists, VIPs and famous people with fake tits who have opinions about everything, about how to eat, how to dress, what to think about one person or the other, on what's right to do or how it would be right to answer in a certain situation. On everything that is related to our existence. And so our opinions are nothing but the mirror of somebody else's point of view.

There are even accountants who instead of taking care of your balance, spend time writing philosophy treaties about friendship between man and woman. Who then go into politics and spread the idea that the future of a city is in the creation of a luxury area. And people vote them, because after all they have an opinion.

We need to change perspective, the way of seeing things by creating an opinion that is truly ours, based on our own knowledge. The question is: is it us who choose, based on our convictions, or do we let ourselves fooled by what is given to us already chewed?  What do we really base our choices upon? After all these years we're in the same situation of crisis, unhappiness and pessimism, and yet we continue to not have our own opinion.

Many people don't want to think, analyze and take responsibility for their individual choices, by putting the signature on a choice based on ideas that are given to us by others and that are not the result of their own analysis. They leave everything in the hands of the greedy of power, the ones that take the power for themselves and don't do anything to earn it.

During the last few years we've seen a general disinterest, a lack of affection for politics, I feel like people take everything lightly by letting themselves fascinated by the words of whoever shouts the loudest.

We're more and more attracted by gossip, by tv shows covered in insults, because whatever amazes us in a negative way makes us angry: so we waste our time thinking of useless things. Because when we're stunned and angry we can express our opinion. It's that easy, no need for studies in order to understand what's going on. The trend matters, we're a little bit snobs, and we're afraid of what others might say if we think or act differently.

We really need to understand that nothing's going to go back to how it was, and now more than ever we must open our hearts and minds and be less suspicious about cultural change, to what's different, and learn to listen, analyze and ask questions. And from here start to give answers that truly belong to us and are not imposed by others' opinions.

#DirittiUmani: l'Italia dei diritti ancora poco umani



Tempo di elezioni e tempo di richieste concrete ai candidati. Amnesty Italia ne ha raccolte 10 su un tema che nel nostro paese difficilmente trova spazio nell'agenda politica ed è sempre troppo retorico in quello della società civile: i diritti umani.

Quella dell'Italia e dei diritti umani è una storia che ha visto parecchi travagli negli ultimi anni. Dall'immigrazione alle discriminazioni di genere passando per le carceri, le cronache sono piene, purtroppo, di fatti che lasciano abbastanza perplessi sullo stato del paese in fatto di diritti.

Da ultima ha trovato spazio sulle pagine dei giornali la battaglia di Pannella per le carceri, macchia sporca su una pagella dai voti non troppo lindi in materia. Ma siamo il paese della Bossi-Fini, dei cartelloni leghisti con le riserve indiane, della caccia all'immigrato dell'Est costantemente disegnato dai media come stupratore e assassino.

A questo si aggiunga la violenza di genere che va dallo Stalking alla coercizione economica e psicologica molto spesso all'interno di una relazione, alle molestie e gli abusi sessuali e che porta con se ad esempio il dramma del femminicidio che nell'ultimo anno ha visto numeri drammaticamente da record nel nostro paese, tema che su queste pagine avevo trattato qui. In merito andrebbe letta anche la Relazione sull'Italia della Relatrice speciale dell'Onu, Rashida Manjoo, sulla violenza di genere pubblicata sul sito di Amnesty Italia e il rapporto Istat 2006 sulla violenza contro le donne per farsi l'idea dei numeri e dell'allarme sociale che evidenzia.

Non c'è dunque da stupirsi troppo se, notizia recentissima, il nostro paese in fatto di diritti umani è maglia nera, dietro a Russia e Turchia, come fotografa "il Rapporto della Corte europea dei diritti dell'Uomo del 2012".

Quello che serve al nostro paese sono riforme, dal sistema carcerario a quello giudiziario ad esempio. E' dell'8 gennaio la notizia della condanna dell'Italia da parte dell'UE per il problema, mai risolto, del sovraffollamento delle carceri. Ma non è l'unica nota di demerito. L'UE aveva già richiamato il nostro paese giusto un anno fa, in tema di immigrazione, per i respingimenti dei migranti verso la Libia venendo meno ai diritti dei rifugiati (vedi la sentenza sul caso Hirsi).

Vi è inoltre, sul reato di clandestinità eredità dei governi Berlusconi e delle sue leggi in tema di immigrazione, una sentenza della Corte di giustizia dell'UE: il reato dello straniero espulso o respinto che trasgredisce all'ordine del Questore di lasciare il territorio nazionale viola la direttiva UE sui rimpatri e deve essere disapplicato."

A questi problemi, come elencavo all'inizio, vanno aggiunti l'omofobia, la transfobia e la mancanza di diritti per le persone LGBTI sempre più vessati in Italia in cui sulle norme e le sanzioni anti-discriminazione siamo indietro. In questa campagna elettorale sono entrate nel dibattito, con le forze politiche che da mesi mettono bocca sul tema, le unioni civili e i matrimoni gay. Ma quella che manca a priori è una vera sensibilità e una composta serietà nei toni  del dibattito riguardo al tema alla diversità, a partire dalle istituzioni siano esse laiche o religiose che si concentrano sul dito senza degnarsi di guardare il problema principale che sta dietro. Si vedano alcune delle ultime uscite politiche o della chiesa o alle purtroppo famose affermazioni dell'On. Giovanardi in materia (ne avevo parlato qui).

Nei dieci punti di Amnesty rientra anche la richiesta per l'introduzione del reato di tortura e la trasparenza delle forze dell'ordine. Questo punto richiama inevitabilmente ai fatti del G8 di Genova, di cui una parte dei responsabili è rimasta impunita nonostante le gravi violazioni, fatti che sono nuovamente sul tavolo della corte europea dei diritti dell'uomo dopo i ricorsi seguiti alla sentenza.

A questi, e lo metto io, andrebbe aggiunto il diritto di voto ai figli di immigrati di seconda generazione nati sul suolo Italiano.

Amnesty Italia ha riassunto questi punti in un sito ad hoc con i quesiti e gli approfondimenti in materia e inviato il tutto ai principali candidati o esponenti di partiti, liste o movimenti politici in corsa per le prossime politiche di febbraio 2013 invitandoli a rispondere su questi temi cruciali per rendere l'Italia un paese moderno e non più fanalino di coda in fatto di diritti. Vedremo se e cosa risponderanno.

Ma oltre alla risposta politica è necessaria una riflessione e l'apertura di un dibattito ampio (e non retorico) anche nella società civile. Non bisogna aspettare che sia la politica a muovere il primo passo. E' urgente una spinta che venga dal basso, dall'elettore che ha, questo si, il potere di fare pressione ed esigere dai propri rappresentati risposte e fatti. Serve in questo senso la firma dell'appello sul sito sopra citato, ma non basta l'attivismo da click. E' indispensabile un monitoraggio costante sulle istanze in temi di diritti umani che non sono solo dei migranti, dei Gay e dei carcerati, ma pure nostri, di tutti. E prima lo capiremo e meglio sarà.

Italy of the not so human rights (yet)

Elections time and time for true requests to the candidates. Amnesty Italia has collected 10 of tghem on a topic that in our country only with great difficulty can find space in the political agenda and it is always too rethorical in the civil society: human rights.

That of Italy and human rights is a story that has seen many issues during the last few years. From immigration to gender discrimination, to prisons, the chronicals are full, unfortunately, of facts that leave us all quite perplexed and worried about the current situation of the country in the matter of rights.

The most recent one is Pannella's battle for prisons, a dirty stain on a not truly brilliant marks page. But we're in the country of Bossi-Fini, the Northern League banners with the Indian reservations, the hunt to the immigrant from the East, constantly drawn by the media as a rapist and a murderer.

To this add the gender violence that goes from stalking to economical and psychological constraint, very often inside a relationship, from harassment to sexual abuse, that bring along the tragedy of femicide, that during the last year has seen record numbers in our country, a topic that I had tackled on these pages a while ago. Everyone should also read the Report on Italy by the special reporter for the UN, Rashida Manjoo, about gender violence published on the website of Amnesty Italia and the Istat report 2006 on the violence against women to get an idea of the numbers and the social alarm they put in light.

No wonder if, and this is fresh news, our country in the matter of rights is last, after Russia and Turkey, as the Report of the European Court for Human Rights in 2012 enhances.

What are country needs are reforms, from the prison system to the judiciary system. On the 8th of January the news broke that Italy has been condemned yet again by the EU for the never resolved problem of crowded prisons. But it's not the only note of blame. The EU had already recalled Italy an year ago, on the topic of immigration, because of the refusal to accept the immigrants from Lybia, thus going against refugees rights. (see the judgment of the case Hirsi)

Furthermore there is a verdict about the fellony of illegal migration, a gift from the Berlusconi governments and his laws about immigration, emitted b the Justice Court of EU: the fellony of the foreigner that is expelled or rejected, and who disobeys the order to leave the national territory violates the EU directive about repatriation and should not be applied.

To these problems, as I said in the beginning, you must add homophobia, transphobia and the lack of rights for LGBTI people, more and more pressed in Italy, whose norms and sanctions against discrimination are very far behind. In this elections campaign we've seen a few topics enter the debate, civil unions and gay marriage. But what's truly missing is a true sensitivity and seriousness of the tones of the debate regarding diversity, starting from istitutions, whether they're laicist or religious, who always concentrate on the finger without even looking at the main problem. Just look at the last political or religious declarations, or the now sadly famous statements of On. Giovanardi about the matter.

In these ten points Amnesty also puts the request for the introduction of the fellony of torture and the transparency of law enforcement. This point recalls the facts of the Genova G8, where a large part of the responsibles have remained unpunished in spite of the serious violations, facts that are yet again on the table of the European Court for human rights after the verdict. To these, I'd say, we should also add the right to vote for the children of immigrants of second generation, born on Italian territory.

Amnesty Italia has summed up these points in a website with the questions and details and sent everything to the main candidates or party leaders, lists or political movements running for the next political elections in February 2013, inviting them to answer to these crucial points in order to make Italy a modern state, and not the last arrived when it comes to rights. We'll see what they're going to answer.

But beyond the political answer, it is necessary to open a reflexion and a wide debate in the civil society. We must not wait for politics to make the first step. A drive from below is necessary and urgent, from the voter who has the power to make pressure and demand answers and facts from his representatives. We do need to sign the petition on the aforementioned website, but it's not enough to do some click activism.

It is vital to keep a constant monitoring on the topic of human rights that aren't just those of immigrants, gays and convicts, but ours, all of us. And the sooner we'll understand that, the better.

#Gaza e #Israele, la lunga strada verso la pace in #Palestina



Il conflitto tra Israele e Palestina si protrae ormai da decenni, tra escalation violente e fugaci tentativi di trovare un qualche accordo di pace. Ma fino a che mancherà la volontà politica degli interessati e della comunità internazionale sarà difficile trovare una soluzione definitiva.

Qualche giorno fa il presidente dell'autorità palestinese, Abu Mazen aveva rilasciato un'intervista alla TV israeliana Channel 2 in cui di fatto accettava la soluzione a due stati (riconoscendo quindi Israele) ma ribadendo il punto sui confini che per Abu Mazen devono essere quelli del 1967.

L'altra cosa da sottolineare è, almeno a parole, la rinuncia al diritto dei profughi di Palestina al ritorno nella loro terra. Lui stesso ha dichiarato che avrebbe visitato Safed (città in cui è nato) da turista. Queste dichiarazioni hanno ovviamente attirato critiche su di lui da parte della sua gente, ma Abu Mazen aveva anche fatto capire di non essere sicuro che i profughi del 1948 (sparsi tra Giordania, Libano e Siria) avessero davvero voglia di tornare ora dopo anni di integrazione in quei paesi.

Il punto fermo nelle trattative rimane però  l'interruzione dell'espansione degli insediamenti israeliani durante i negoziati. Ovviamente Israele da quel punto di vista non intende ragione, e anzi ha approvato la costruzione di altre colonie. Allo stesso modo nessuna risposta da parte di Netanyahu sulla questione dei confini.

Insomma, Abu Mazen aveva praticamente calato i calzoni in quella intervista, ma dal lato Israeliano invece che afferrare la palla al balzo si è preferito di fatto ignorare le sue parole dialoganti e procedere con l'azione Pillar of Defense, iniziando con l'uccisione di Ahmed Jabari, e questo ha  rafforzato Hamas legittimandone l'azione. A chi giova? Beh diciamo che il fatto che Israele sia sotto elezioni ha probabilmente portato Netanyahu a decidere per l'intervento (già programmato) per arginare quell'opposizione che invece mette sul tavolo le questioni economiche e sociali (ad esempio quella) degli affitti denunciata anche dal movimento J14.

Perciò mostrarsi deciso sul caso Gaza è probabilmente un tentativo di spostare l'attenzione dell'israeliano medio su fattori esterni al paese. Dall'altro lato Hamas con le sue azioni tenta di apparire come l'unica alternativa (vista anche la corruzione di Fatah) agli occhi dei palestinesi, e l'unica in grado di rispondere ad Israele, con lo stesso soldo: azioni violente. Ma di più, ottenendo il sostegno di molti paesi arabi e l'appoggio importante dell'Egitto.

Questo indebolisce fortemente quella parte moderata e predisposta al dialogo diplomatico che è rappresentata da Abu Mazen e dall' ANP e legittima ulteriormente i falchi di Hamas (già forti del consenso elettorale nei territori di Gaza). I cortei di protesta contro il governo di Abu Mazen organizzati negli ultimi giorni all'interno della West Bank ne sono una prova.

Ci si ritrova così, da un lato con due forze politiche palestinesi, Hamas e Fatah, incapaci di trovare un percorso comune e dall'altro con un Governo Israeliano che continua, nonostante le (deboli) proteste della comunità internazionale, ad espandere gli insediamenti oltre ad una serie di altre azioni messe in atto nei confronti dei palestinesi che nessuno (o quasi) durante l'anno viene a raccontarvi quasi mai.

Ad esempio di come viene razionata (per non dire privata) la fornitura d'acqua ai villaggi palestinesi a favore degli insediamenti israeliani che sorgono nei pressi, e che lì non dovrebbero stare. E nessuno viene a raccontarti delle ore e ore di fila che un palestinese, per bambino, donna o anziano che sia, deve affrontare ogni giorno per arrivare dal lato opposto di un check-point militare. Ma c'è di peggio. Nessun paese occidentale, cosiddetto democratico, nonostante azioni aberranti come quella che fu Piombo Fuso, ha avuto e ha tutt'ora il coraggio di opporsi diplomaticamente ad Israele. In barba ai principi di civiltà e democrazia.

In tutto questo roboante drammatico teatrino politico portato avanti a suon di bombe e missili chi ci rimette  sono sempre i più deboli, i bambini, le donne, i civili inermi che la così acclamata guerra chirurgica israeliana falcia ad ogni attacco nella striscia di Gaza. E lo stesso vale per Israele e i suoi abitanti vittime di missili e attentati che per quanto di minor efficacia portano comunque danni e vittime.

Fino a che gli equilibri saranno lasciati nelle mani di forze politiche mal disposte al compromesso e alla trattativa, fino a che gli organismi internazionali non si decideranno ad applicare con coraggio sanzioni anche all'alleato intoccabile Israeliano, i cittadini dei rispettivi paesi saranno loro malgrado vittime di un gioco politico di cui le generazioni di oggi pagano le conseguenze senza avere in fin dei conti la colpa del peccato originale.

Intanto, mentre scrivo questo articolo arriva l'annuncio di un accordo di cessate il fuoco. Quanto sarà duratura questa tregua non è dato saperlo. Quello che invece sarà fondamentale è l'impegno della diplomazia tutta affinché in questa finestra di tregua riesca a trovare le basi per riaprire un road map che porti alla pace.

Gaza and Israel, the long road towards peace in Palestine

The conflict between Israel and Palestine has been going on for decades, among violent escalations and brief attempts to find a peace agreement. But until the political will of those who are interested and of the international community will be lacking, it will be difficult to find a definite solution.

A few days ago the president of the Palestinian authority, Abu Mazen, had given an interview to the Israeli TV Channel 2, during which he practically accepted the two state solution (recognizing Israel), but stressing the point that the borders should be those of 1967.

The other thing is, at least in words, the fact that he gave up the right for Palestinian refugees to go back to their lands. He stated that he visited Safed, his birth city, as a tourist himself. These statements have obviously attracted criticism from his own people, but Abu Mazen had also made clear that he wasn't sure that refugees from 1948, scattered in Jordan, Libanon and Syria, actually wanted to come back after years of integration in those countries.

The one point that doesn't change is the interruption of the expansion of Israeli settlements during negotiations. Obviously Israel doesn't want to discuss this matter, and has approved the building of other colonies. Same thing on behalf of Netanyahu on the matter of borders.

So basically Abu Mazen had lowered his pants in that interview, but on the Israeli part they preferred to ignore his words instead of catching the opportunity, and the proceeded with the action Pillar of Defense, starting with the killing of Ahmed Jabari, which has enforced Hamas and legitimated its action. Who benefits from all this? Let's say that the fact that Israel is under elections has probably brought Netanyahu to decide for the (already programmed) intervention in order to confine that opposition that talks about the economical and social matters, (for example) the problem of rents tackled by the J14 movement.

So proving himself very firm on the Gaza case is probably an attempt to shift attention of the medium Israeli on factors that are outside of the country. On the other side Hamas with its actions tries to appear as the only alternative (given the corruption of Fatah) to the eyes of Palestinians, and the only one capable to respond to Israel with the same coin: violent actions. Even more, obtaining the support of many Arabic countries and the vital support of Egypt.

This weakens strongly the moderate side, the one open to diplomatic dialogue represented by Abu Mazen and the ANP, and legitimates Hamas' eagles even more (they're already strong because of the electoral consent in Gaza territories). The protest manifestations against the Abu Mazen government organized during these last few days inside the West Bank are a proof of it.

So here we are, with two political Palestininan forces on the one side, Hamas and Fatah, incapable of finding a common path, and on the other side an Israeli Government that continues, in spite of the (weak) protests of the international community, to expand its settlements, apart from a series of other actions against Palestininans that nobody (or almost) says anything about during the year.

Like the way water supplies are rationalized or stopped altogether in Palestinian villages in favor of Israeli settlements growing nearby, and that shouldn't even be there. And nobody tells you about the hours of line that a Palestinina, be it child or woman or old man, must face every day in order to get on the opposite side of a military check-point. But there's worse. No western country, which can call itself democratical, in spite of absurd actions such as Melted Lead, has had and has the courage of opposing diplomatic resistance to Israel. So much for civilization and democracy principles.

In all this roaring drammatic, political theatre brought forward on the sound of bombs and rockets who loses are always the weakest, the children, the women, the helpless civilians that the so praised surgical Israeli war brings down with every attack to the Gaza strip. And the same is true for Israel and its civilians, victims of rockets and attacks that, even though are not as effective, still cause damage and victims.

Until the balance will be left in the hands of political forces that aren't open to compromise and negotiation, until the international organisms won't decide to apply with courage sanctions even to the untouchable Israeli ally, the citizens of those countries will be victims of a political game in which today's generations pay the consequences without even being guilty of the original sin.

In the meanwhile, as I write this article the announcement of a cease fire truce arrives. How long it will last, we cannot know. What will be fundamental is the diplomacy work so that this truce window may find the basis to reopen a road map that bring to peace.

#FreeSaeed e la libertà di Internet in #Iran



In questi giorni si decide il destino di Saeed Malekpour, programmatore e webdesigner condannato a morte in Iran. Sfortunatamente solo pochissimi ne stanno parlando, e le speranze di riuscire a salvarlo sono davvero scarse.

Saeed è nato nel 1975 in Iran. Dopo essersi laureato alla Sharif University di Teheran, nel 2004 Saeed si è trasferito in Canada con la moglie Fatima, conosciuta durante un torneo di scacchi, e dal 2005 è diventato un residente permanente.

Nell'Ottobre del 2008 Malekpour decide di rientrare nel paese di origine per assistere il padre gravemente malato e ormai morente, ma le autorità iraniane lo arrestano con l'accusa di creazione e moderazione di siti pornografici. Malekpour aveva creato un software per caricare foto su Internet, che è stato poi usato (a sua insaputa) per la costruzione di un sito per adulti.

Saeed è stato trasferito nella prigione di Evin, e inizialmente tenuto in isolamento senza rappresentazione legale per un intero anno. Un anno dopo il suo arresto, Malekpour ha confessato i suoi crimini alla TV di stato iraniana. In seguito ha ritrattato la sua confessione in alcune lettere inviate dalla prigione: "Gran parte della mia confessione è stata estorta sotto pressione, tortura fisica e psicologica, minacce a me e alla mia famiglia, e false promesse di rilascio immediato se avessi fornito una falsa confessione [...]. Questo trattamento aveva lo scopo di forzarmi a scrivere quello che i miei interrogatori mi dettavano, e costringermi a interpretare un ruolo davanti alle videocamere, secondo i loro scenari."

Nel Dicembre del 2010, Saeed è stato condannato a morte dopo essere stato trovato colpevole di "creazione e moderazione di siti per adulti", "agitazione contro il regime", e "insulto alla santità dell'Islam." Nel Giugno del 2011, tuttavia, la Corte Suprema dell'Iran ha annullato il verdetto a causa delle proteste del governo Canadese. Dopo questo sovvertimento, Malekpour è rimasto in prigione mentre il suo caso veniva rivisto.

Nonostante la decisione iniziale, la Corte Suprema ha annunciato che il suo verdetto non era concludente e ha rimandato il caso alla corte che aveva giudicato Malekpour inizialmente. La condanna a morte è stata confermata, e nel Gennaio 2012 la Corte Suprema ha respinto l'appello degli avvocati di Malekpour. Il governo Canadese ha condannato questa decisione e chiesto il rilascio immediato di Saeed.

Anche Amnesty International ha chiesto il suo rilascio, descrivendo il caso come parte di un "attacco generalizzato alla libertà di espressione in vista delle elezioni parlamentari iraniane nel mese di Marzo."

#FreeSaeed and the freedom of Internet in #Iran

During these days the fate of Saeed Malekpour is being decided. Saeed is a programmer and webdesigner who was been sentenced to death in Iran. Unfortunately not many are talking about it, and the hopes of saving him are growing thin.

Saeed was born in 1975 in Iran. He is a graduate of the Sharif University of Technology in Tehran. In Iran, Malekpour married Fatima Eftekhari whom he met at a chess competition. In 2004, Malekpour went to Canada with his wife to pursue educational opportunities. He became a permanent resident of Canada.

In October 2008, Malekpour visited his dying father in Iran, and Iranian authorities arrested Malekpour during his visit, accusing him of designing and moderating pornographic websites. Malekpour had designed a photo uploading software, and according to his supporters that software was being used without his knowledge for the creation of an adult website.

Malekpour has been kept in Iran's Evin prison, and was initially placed for almost a year in solitary confinement without legal representation. A year after his arrest, Malekpour confessed to his crimes on Iranian state television. He later retracted the confession in letter sent from inside prison. Malekpour wrote, "A large portion of my confession was extracted under pressure, physical and psychological torture, threats to myself and my family, and false promises of immediate release upon giving a false confession to whatever the interrogators dictated ... Such mistreatment was aimed at forcing me to write what the interrogators were dictating, and to compel me to play a role in front of the camera based on their scenarios."

In December 2010, Malekpour was sentenced to death after being found guilty of "designing and moderating adult content websites", "agitation against the regime", and "insulting the sanctity of Islam". In June 2011, however, the Supreme Court of Iran reportedly annulled the verdict in the face of Canadian government protests. Following the reversal, Malekpour was set to remain in jail while a judicial review into his case was held.

Despite its earlier decision, the Supreme Court announced its verdict was inconclusive and remanded the case to the court that originally sentenced Malekpour. The death sentence was upheld, and in January 2012, the Supreme Court rejected an appeal from Malekpour's lawyers. The Canadian government condemned the decision and called for Malekpour's immediate release.

Amnesty International also called for his release, describing the case as part of a general "crackdown on freedom of expression ahead of the Iranian parliamentary elections in March".
