#Privacy e pubblicità, l'appello del #Garante sui cookie



La normativa europea sui cookie è stata infine recepita anche in Italia. Tutti i Paesi europei sono tenuti ad armonizzare le proprie regole nazionali per recepire le nuove direttive europee, delle quali avevo già parlato un anno fa alla loro pubblicazione.

In Italia Il garante per la Privacy ha appena avviato una consultazione pubblica volta ad individuare modalità semplificate per l'informativa sui cookie. I soggetti invitati a partecipare alla consultazione sono le associazioni maggiormente rappresentative a livello nazionale dei consumatori e delle categorie economiche coinvolte,  le università e i centri di ricerca. Tutti gli interessati possono inviare un'email all'indirizzo consultazionecookie@gpdp.it. La consultazione ha una durata di 90 giorni a partire dal 18 dicembre 2012 (quindi c'è tempo fino al 18 marzo 2013 per presentare i propri suggerimenti). Con questo post intendiamo sensibilizzare l'opinione pubblica, e invitiamo in particolare gli operatori economici della rete a presentare i propri suggerimenti per semplificare al massimo la procedura.

In estrema sintesi per la direttiva è necessario informare ed acquisire il consenso degli utenti se si desidera effettuare una profilazione di carattere pubblicitario attraverso l'installazione di cookie. Nessun problema invece per i cookie tecnici, quelli necessari ad una corretta fruizione di un servizio internet, dei quali va comunque comunicata la presenza.

Prima di entrare in materia, c'è da dire che quella europea è una normativa che arriva in forte ritardo, alla presenza di consolidate forme di autoregolamentazione avanzata, che vedremo tra poco.

C'è da dire che sarebbe stato meglio regolare i cookie a livello di browser, lì dove si possono gestire ed eventualmente cancellare. Che poi per me è sempre stata una questione di marketing del nome. Cookie significa biscotto dolce, è un termine inglese americano che ha la sua origine dall'olandese del '700 (koekje). In Italia, dove una volta superate le brutture dell'autarchia fascista che obbligava a tradurre in italiano tutti i termini, ci siamo ormai abituati ad assimilare senza tradurre qualsiasi termine tecnico informatico. Fatto sta che cookie, in italiano suona malissimo, e nell'immaginario comune sembra il cugino del worm e del trojan, un malware. In realtà il cookie non è il male. Il cookie è utile, è simpatico. Ti aiuta ad ottenere un servizio migliore senza chiederti noiose iscrizioni o di rilasciare te stesso quelle informazioni. Ma l'Unione Europea ha deciso di regolare questo accordo implicito tra il navigatore e siti che fanno utilizzo di cookie (in pratica tutti, chi più, chi meno).

Che informazioni ottengono i cookie?

A destra potete vedere un'immagine che rappresenta i siti che hanno ottenuto le mie informazioni di navigazione in una fascia oraria di 48 ore. I punti in rosso rappresentano i media che hanno rilasciato i cookie con finalità di tracciamento pubblicitario, quelli in grigio invece fanno ricorso a cookie di servizio (ma non sappiamo se facciano altri tracking di tipo pubblicitario). Ok, quando si tratta di navigare su internet io non scherzo, ma una mappa così complessa si può ricavare per la maggior parte di noi. Ma che tipo di dati hanno ottenuto da questa mappatura i vari siti internet e i servizi di terzi associati? Essenzialmente i dati di navigazione proveniente dal mio computer. I network possono così costruire profili pubblicitari, e i proprietari dei siti realizzare contenuti migliori e personalizzarli ai miei gusti. Nessun problema. Ciò che potrebbe non andar bene è che questi dati possano essere incrociati con quelli di Facebook, o di altri social network in possesso delle mie informazioni sensibili. Se si viene a sapere che dal mio computer partono attività di navigazione che possano aiutare ad identificare la mia sfera sessuale, politica, religiosa (esempi di informazioni sensibili), non ho nulla in contrario. Ma se qualche media riuscisse ad incrociare queste informazioni risalendo alla mia identità (magari tramite Facebook) questo sarebbe un problema. La raccolta delle informazioni tramite cookie è sempre stata anonima. Oggi è invece possibile che questi dati vengano incrociati con quelli dei nostri profili sui social media. E' da questa congiunzione che possono nascere problemi di privacy, e questo territorio non pare ancora oggetto di regolamentazione da parte dell'UE.

Autoregolamentazione: cosa fanno i big di Internet per mantenere un atteggiamento rispettoso della nostra privacy?

Partiamo da Montain View, dove ha sede il motore di ricerca di internet. Google costruisce profili pubblicitari basati sul tracciamento dei cookie e su altre informazioni in suo possesso, come le nostre ricerche. Queste informazioni sono utilizzate per presentarci pubblicità il più possibile mirata al profilo che è stato costruito intorno al nostro account Google. Nel mio caso è abbastanza corrispondente: hanno individuato il mio profilo demografico e hanno individuato le categorie di siti internet che maggiormente mi interessano. In altri casi la corrispondenza è meno efficacie. Google consente di disattivare questo tracking in maniera definitiva. Ve lo sconsiglio. Fare output non vuol dire che non vedrete più pubblicità, ma che essa sarà meno pertinente e interessante per voi. Io piuttosto immagino un mondo in cui davvero ci vengono proposti annunci pubblicitari in base alle nostre esigenze, senza per questo ricevere pubblicità invadenti.

L'altro gigante della pubblicità è Facebook. Il profilo demografico è qui costruito dalla persona, e non indovinato come nel caso di Google (il quale però attraverso il proprio social network Google+ sta colmando il gap, con oltre 500 milioni di profili in tutto il mondo). Il targeting per interessi è quindi derivato dalle preferenze rilasciate dall'utente, come i brand di cui si è fan. Anche il popolare Social Network con sede a Palo Alto permette di modificare le opzioni pubblicitarie, dove ad esempio è possibile disattivare le Social Ads, che permettono alle aziende di utilizzare le nostre interazioni con i brand per finalità pubblicitarie.

Per iniziativa dello IAB, l'Internet Advertising Bureau, l'ente che dal 1996 riunisce i principali media pubblicitari della rete,  è possibile disattivare il tracciamento tramite cookie di alcuni o di tutti i principali network di monitoraggio pubblicitario. Questa scelta non è definitiva, ma è necessario tornare a visitare la pagina regolarmente. Ed è qui che si può notare il problema intorno alla regolamentazione cookie. I cookie non sono controllati dai pubblicitari, ma da chi possiede il computer.

 Suggerimenti per il garante

Dia tempo alle società per mettersi in regola, almeno fino a dicembre 2013. Faccia una deroga per i blog - i quali potranno comunque fare ricorso a servizi come quello di Iubenda (su Intervistato trovate un'intervista al suo fondatore Andrea Giannangelo). Cerchi di collaborare con i browser per far comprendere facilmente cosa sono i cookie e come rimuoverli; con i network pubblicitari lavori su informative presenti direttamente all'interno degli spazi pubblicitari.

Per i siti internet venga dato spazio all'informativa cookie all'interno del footer del sito, a piè pagina. In questa sezione i visitatori di internet sono abituati a trovare informazioni sul sito che stanno visitando, come le informazioni di contatto e le altre informative sulla privacy.

Alla registrazione di uno qualsiasi dei servizi del sito, si includa l'informativa sui cookie alle informative privacy e sull'utilizzo dei dati per finalità pubblicitarie.

Il Garante della Privacy, cui va dato atto di grande intelligenza nell'avviare una consultazione pubblica, semplificando questa regolamentazione, non farà un favore solo agli operatori del settore, ma anche agli utenti della rete.

Privacy and advertising, the Guarantor appeal on cookies

The European regulamentation on cookies has finally been received in Italy as well. All European countries must harmonize their national laws in order to receive the new European directives, of which I had already talked one year ago at their publication.

In Italy the privacy guarantor has just started a public consulation with the aim of finding simplified modalities for the informative on cookies. Those invited to participate are the associations that are mostly representative at a national level of consumers and the economical categories involved, universities and research centres. All those who are interested can send an email to the address consulazionecookie@gpdp.it. The consultation has a duration of 90 days starting December 18th 2012, so there's time untile March 18th to present suggestions. With this post we intend to sensibilize the public opinion, and we invite particularly economical operators of the web to present their suggestions to simplify the procedure as much as possible.

Although cookies cannot carry viruses, and cannot install malware on the host computer, tracking cookies and especially third-party tracking cookies are commonly used as ways to compile long-term records of individuals' browsing histories — a major privacy concern that prompted European and US law makers to take action in 2011.

Other kinds of cookies perform essential functions in the modern Web. Perhaps most importantly, authentication cookies are the most common method used by web servers to know whether the user is logged in or not, and which account they are logged in under. Without such a mechanism, the site would not know whether to send a page containing sensitive information, or require the user to authenticate himself by logging in. The security of an authentication cookie generally depends on the security of the issuing website and the user's web browser, and on whether the cookie data is encrypted. Security vulnerabilities may allow a cookie's data to be read by a hacker, used to gain access to user data, or used to gain access (with the user's credentials) to the website to which the cookie belongs (see cross-site scripting and cross-site request forgery for examples).

What kind of information do cookies collect?


Cookies may be used to remember the information about the user who has visited a website in order to show relevant content in the future. For example a web server may send a cookie containing the username last used to log in to a website so that it may be filled in for future visits. Many websites use cookies for personalization based on users' preferences. Users select their preferences by entering them in a web form and submitting the form to the server. The server encodes the preferences in a cookie and sends the cookie back to the browser. This way, every time the user accesses a page, the server is also sent the cookie where the preferences are stored, and can personalize the page according to the user preferences. For example, the Wikipedia website allows authenticated users to choose the webpage skin they like best; the Google search engine once allowed users (even non-registered ones) to decide how many search results per page they want to see.

Autoregolamentation: what are the big of the Internet doing to maintain a respectful behavior towards our privacy?

The industry’s response has been largely negative. Some view the Directive as an infernal doomsday machine that will "kill online sales" and "kill the internet". Robert Bond of the law firm Speechly Bircham describes the effects as "far-reaching and incredibly onerous" for "all UK companies." Simon Davis of Privacy International argues that proper enforcement would "destroy the entire industry".

The P3P specification includes the possibility for a server to state a privacy policy, which specifies which kind of information it collects and for which purpose. These policies include (but are not limited to) the use of information gathered using cookies. According to the P3P specification, a browser can accept or reject cookies by comparing the privacy policy with the stored user preferences or ask the user, presenting them the privacy policy as declared by the server.

Many web browsers including Apple's Safari and Microsoft Internet Explorer versions 6 and 7 support P3P which allows the web browser to determine whether to allow third-party cookies to be stored. The Opera web browser allows users to refuse third-party cookies and to create global and specific security profiles for Internet domains. Firefox 2.x dropped this option from its menu system but it restored it with the release of version 3.x.

Third-party cookies can be blocked by most browsers to increase privacy and reduce tracking by advertising and tracking companies without negatively affecting the user's Web experience. Many advertising operators have an opt-out option to behavioural advertising, with a generic cookie in the browser stopping behavioural advertising.

Graffiti Personal Branding



Spesso gli insegnamenti migliori vengono dalla commistione tra temi tra loro apparentemente distanti. Una riflessione a posteriori, in questi ultimi anni nei quali in Italia si è parlato spesso di Personal Branding, l'ho fatta agli insegnamenti insiti nella subcultura urbana dei Graffiti, una vera e propria community di singoli dalle spiccate peculiarità distintive.

Da adolescente avevo una grande creatività e voglia di comunicare e mi sono lasciato affascinare dal movimento globale del writing, il fiorire di complesse forme scritte a colorare i muri delle città in bilico tra forma d'arte e vandalismo. Ho fatto graffiti per diversi anni, prima di spostare la mia creatività su altri fronti e seguito sino ad oggi con interesse le evoluzioni del movimento verso la street art, che vede oggi i suoi massimi artefici esprimersi con installazioni e raffigurazioni iconiche al limite di un movimento neo-pop.

Se oggi, in piena era dell'economia dell'informazione, diventiamo tanto più utili alla società in quanto capaci di renderci indispensabili grazie a doti uniche, connotarsi di un brand personale è il metodo più efficace per distinguersi  dagli altri. Le dinamiche che si venivano a creare nelle community di artisti (o vandali dirsivoglia) dello spray viste anni dopo da un punto di vista differente possono dare qualche spunto anche provocativo sulla definizione di alcuni concetti di Personal Branding.

La tag è il tuo brand

Capitava che in molti nemmeno si conoscessero di nome, nell'ambiente dei graffiti. Il nome d'arte del graffitaro, in gergo la sua tag, era qualcosa di più, un marchio, un impronta riconoscibile sul territorio, in cui a sua volta riconoscersi e da portare con trasporto. Molti la sceglievano in quanto combinazione felice di lettere che si prestano a rappresentare le forme e lo stile ricercato. Il nome con cui ci si presenta negli ambienti di lavoro o di networking, analogamente ad una tag, è l'unico che verrà ricordato ed è tanto importante quanto il nome di un'azienda. I casi più particolari sono quelli in cui abbiamo nomi molto comuni o abbiamo un omonimo molto più famoso di noi: in questi casi è consigliabile scegliere una versione leggermente differente del nome (ad esempio recuperando un soprannome, un diminutivo del nome, o un secondo nome) o adottare un vero e proprio nome d'arte. Una sorta di tag, appunto.

Lo stile, lo stile... è tutto lì si diceva. Si fa presto a diventare puppet, marionette del sistema che si connotano con stili non propri e non padroneggiano le tecniche. Se è vero che la tendenza principale nell'ambiente delle bombolette spray era quella di stare dentro la cultura hip hop, presto scoprivi che i migliori avevano tutti delle proprie storie particolari, quello che ascoltava il punk, l'appassionato di arte rinascimentale, il naif, quello che tutti dicevano che era matto come un cavallo e lui invece se la rideva. Far parte di un movimento, di una community, di un'industria di professionisti non vuol dire appiattirsi ed essere tutti uguali, anzi per emergere serve stile e originalità.

Ottimizzazione

Costavano quelle bombolette. D'importazione, con cataloghi scintillanti con l'indicazione di tutte le tonalità di colore RAL, con tappini di varie fogge per gittate di spray più o meno sottili o vaporizzate. Qualche volta capitava che con risorse limitate si doveva produrre un pezzo, magari solo con i fondini (gli avanzi di vernice rimasti su bombolette spray giù utilizzate). Come un grande chef che con gli avanzi del pranzo della domenica riesce a ricavare un piatto ricercato, un pilota di Formula 1 che si piazza in pole position con una macchina ancora da rodare, un professionista emerge nelle sue qualità e doti caratteristiche in un momento di risorse scarse, attraverso l'ottimizzazione e l'utilizzo creativo di risorse limitate.

Associazione ad altri brand: dediche

 Completato il pezzo (nel gergo il singolo graffito), era il momento delle dediche. Prima ai compagni più vicini, componenti del proprio gruppo, spesso accomunati da una sigla, poi magari ad un writer più famoso solo per evidenziare di averlo conosciuto, o in segno di rispetto, o di ringraziamento per aver concesso di dipingere quel muro che prima ospitava un'altra opera che iniziava a scrostare il velo di vernice. L'associazione ad altri Personal Brand a cui si vuole aspirare è l'unico metodo sostenibile in una community per elevare il proprio Brand. Le associazioni vanno fatte per vicinanza e con coerenza, e le si possono fare se il proprio Brand attira giudizi positivi. Fate i bravi, se volete associarvi a quelli che per voi sono i migliori.

Lo stile originale è tutto. E quando uno più famoso di te ripropone, pur con una tecnica più sopraffina e qualche miglioria, un pezzo con colori e forme quasi identici a quello realizzato da te, non ci rimani molto bene. Ma una community si muove con stilemi, messaggi, retaggi ricorrenti, come un unico organismo in evoluzione verso un nuovo stadio. Se qualcuno più famoso ti copia un'idea, se diffonde un tuo messaggio anche senza citarti, non è negativo. Sei entrato nella sua sfera d'influenza. Pazienza se alle masse l'idea risulterà sua perché è più famoso, ti sei guadagnato un credito per entrare in contatto con lui.

Non invadere il territorio altrui

Abbiamo imparato che con una tag si marchia un territorio, che un muro dipinto da un altro è taboo se non si fa parte della sua cerchia. In realtà la strada, i muri, rappresentavano in uno scenario comunque controverso e sempre al limite della legalità il perfetto archetipo di un libero mercato.

Se c'è piena libertà puoi sempre entrare dove vuoi senza chiedere il permesso, ma a tuo rischio e pericolo. Vuoi un consiglio? Non tentare la sorte, meglio chiedere il permesso prima.

Oggi i ragazzi con cui ho iniziato a fare graffiti sono ancora attivi e davvero bravi, ed io forse ho fatto bene ad esprimere la mia creatività altrove. Tutti sappiamo fare qualcosa meglio di altri, dobbiamo solo trovare di che si tratta.

Graffiti Personal Branding

Often the best lessons come from mixing topics that apparently are distant from one another. I've done some thinking, after all these years of talking about Personal Branding in Italy, about the implied lessons in the urban subculture of Graffiti, a proper community of individuals with highly distinctive and peculiar characteristics.

When I was a teenager I had a great creativity and desire to communicate, so I was fascinated by the global movement of writing, the prosperity of complex written forms which colored the walls of the city, on the endge between art and vandalism. I've done graffiti for several years, before shifting my creativity on other fields, and followed with great interest the evolutions of the movement towards the street art, that sees today its top representatives express themselves with installations and iconic raffigurations that are almost a neo-pop movement.

If today, in the middle of the era of information economy, we become more useful to society when we manage to make ourselves indispensable thanks to unique qualities, getting a personal brand is the most effective way to distinguish ourselves from others. The dynamics that were built in the artist communities (or vandals if you prefer) of the spray, seen after a few years from a different point of view can give some interesting ideas, even provocative, on the definition of some concepts of Personal Branding.

The tag is your brand

It happened that many didn't even know eachother's names, in the graffiti environment. The art name of the artist, or his tag, was something more, a brand, a unique print on the territory, in which to recognize himself and carry around. Many chose it because it was a great combination of letters that are adequate to represent the wanted forms and style. The name with which you introduce yourself in working or networking environments, just as the tag, is the only one that will be remembered and is as important as the name of a company. The most particular cases are those where we have very common names or an omonymous that is much more famous than we are: in these cases it is advisable to choose a slightly different version of the name, or adopt an art pseudonym. A sort of tag, exactly.

The style, the style... it's all there, we used to say. Becoming a puppet, a toy in the system, that use styles that aren't theirs or can't handle the techniques, can happen in no time. If it is true that the main tendency in the environment of spray cans is to stay inside the hip hop culture, you soon discovered that the best had their own particular stories, the one who listened to punk music, the Renaissance art passionate, the naif, the one everyone said was crazy but who laughed about it. Being part of a movement, of a community, of an industry of professionals doesn't mean being all equal, you need style and originality to emerge.

Optimization

Those spray cans used to cost a lot. Imported, with shiny catalogues with the indication of all RAL color tones, with plugs of various shapes and sizes to spray more thinly or vaporized. Sometimes it happened that with limited resources you had to produce a piece, perhaps just with the last paint remains in the cans you used the most. As a great chef, who with the remains of Sunday lunch manages to prepare a premium dish, a Formula 1 pilot who gets in pole position with a car that is still to be prepared, a professional emerges in his qualities and characteristic abilities in a moment of scarse resources, through the optimization and the creative use of limited resources.

Associations with other brands: dedications

Once you completed the piece (the single graffiti), the moment of dedications came. First to the closest companions, components of the group, often united by a single signature, then to a more famous writer in order to show that you met him, or as a sign of respect, or as thanks for the permission to paint that wall that used to host another work which started to fall down. The association with other Personal Brands to which you aspire is the only sustainable way to elevate your Brand in a community. The associations are made by vicinity, and with coherence, and you can make them if your Brand attracts positive feedback. You need to play nice if you want to associate your Brand to those that are the best for you.

The original style is everything. And when someone who is more famous than you reproposes, with a better technique and some better details, a piece with colors and shapes that are almost identical to something you made, you don't take it very well. But a community moves with styles, messages, recurrent quotes, as one individual organism in evolution towards a single stadium. If someone who is more famous copies an idea, if he diffuses your message, even without citing you, isn't negative. You have entered his sphere of influence. It doesn't matter if the masses will think the idea is his, because he's more famous, if you've gained the credit to get in touch with him.

Don't invade someone else's territory

We've learned that with a tag you mark the territory, that a wall that is painted by someone else is a taboo if you're not part of his group. In reality the street, the walls, represented a scenario that was quite controversial and always at the edge of legality, the perfect archetype of a free market.

If there's full liberty you can always go where you want without asking for permission, but at your own risk and danger. Do you want some advice? Don't play with fortune, always better to ask for permission first.

Today the guys I started doing graffiti with are still active and quite good, and perhaps I did well in expressing my creativity elsewhere. We all know how to do something better than others, we only need to find out what it is.
